The difference between trial-court litigation and appellate advocacy is immense.  While trial attorneys must convince a judge or jury that the facts of a case should be interpreted in a particular way, the job of appellate attorneys is to convince a panel of judges to interpret the law in the manner that assists the client.  Careful, creative legal analysis and precise writing are the appellate attorney’s stock and trade.  In the present legal environment, no litigation team is fully staffed without appellate counsel armed with a skill set not often possessed by even the best trial attorneys. 

At Kamlet Reichert, our attorneys have actual, tangible experience briefing appeals and arguing them when necessary.  We understand the difference between being an effective trial court litigator and an effective appellate attorney.

Our attorneys have wide-ranging expertise in handling appellate matters in both federal and state courts.  The members of the Kamlet Reichert appellate practice group are licensed in state and federal appellate courts throughout the nation and they have briefed and argued cases from coast to coast.  They understand the process from the inside out, and have a keen sense of what works and what does not.  That type of knowledge is invaluable to a client who is involved in the appellate process.

The firm handles both routine and complex appeals, as well as writs and petitions for extraordinary relief.  We offer clients a unique resource when faced with complex constitutional, statutory or regulatory issues that require resolution at the highest levels. 

Kamlet Reichert’s appellate group offers its clients a broad range of services including analyzing appellate review opportunities prior to trial, crafting novel and persuasive legal arguments in trial and appellate courts, negotiating resolutions during the post-trial stages of litigation and drafting writs and amicus briefs.  We also consult with trial attorneys who wish to represent their clients on appeal but lack the experience to do so unassisted.

We have represented clients on appeal recently in a wide range of subject areas including corporate and securities matters, contract disputes, employment law, construction litigation, arbitration award confirmations, SEC enforcement, habeas corpus, complex criminal matters and statutory interpretation.

• In 2010, we prevailed in a case before the Colorado Court of Appeals
• In 2009, we prevailed in cases before the Colorado Supreme Court, the Colorado Court of Appeals, the Tenth Circuit Court of Appeals and the Eighth Circuit Court of Appeals
• In 2008 and 2007, our attorneys won six appeals in Colorado alone
• Our attorneys have clerked for appellate court judges in Colorado and elsewhere
